Post-Trial motions have concluded, upholding jury’s unanimous decision which ordered CommScope to pay damages for infringement of U.S. Patent Numbers 9,031,521 and 9,531,473
Menlo Park, California – May 13, 2020 – Dali Wireless, Inc., a worldwide pioneer in digital radio distribution systems and digital predistortion technology, received a final decision from the United States District Court for the Northern District of Texas in Dallas on May 11, 2020 (lawsuit No. 3:16-cv-00477). Chief Judge Barbara Lynn reinforced the jury’s ruling which was first announced on June 19, 2019. The jury sided with Dali Wireless on several case-critical issues, resulting in a favorable decision for Dali Wireless. This final decision from the court upholds the validity of Dali Wireless’ patents.
The final judgement followed a 2–week jury trial in 2019 where the Dallas jury determined that CommScope’s ION-E and FlexWave Prism products infringed Dali Wireless’ patents-in-suit awarding $9 million in damages to Dali Wireless. In the same lawsuit, the jury also determined that Dali Wireless infringed CommScope’s patents and awarded CommScope $1.98 million. The final judgement reinforces the original ruling that both of Dali’s patents are valid and were infringed by CommScope. In addition to the damages awarded by the jury, the court awarded enhanced damages to CommScope and prejudgment interest to both parties. With the court’s entry of final judgment, Dali Wireless will now petition the court to order an accounting and go forward royalty for CommScope’s ongoing infringing sales of ION-E and FlexWave Prism products.
The court suspended an injunction in the United States against Dali Wireless’ t-Series™ and Dali Matrix® products, pending an appeal by Dali Wireless. Because the aging CommScope patents are set to expire very soon and Dali Wireless has developed non-infringing designs, the impact of the injunction on Dali’s go forward business will be minimal.

In May of 2019 Dali Wireless filed a second patent infringement lawsuit against CommScope, in the U.S. District Court for the District of Delaware, alleging infringement of U.S. Patent Numbers 10,045,314; 10,080,178; 9,847,816 and 8,682,338 (case No. 1:19-cv-00952-MN). In that case Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of CommScope’s OneCell®, ION-E®, and Era® in-building systems.
In December of 2019, Dali Wireless filed a willful patent infringement lawsuit in the U.S. District Court for the Western District of North Carolina, Charlotte Division, against Corning Optical Communications LLC, as amended, alleging infringement of U.S. Patent Numbers 10,433,261; 9,197,358 and 10,506,454 (case No. 3:19-cv-714). Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of Corning’s SpiderCloud Enterprise Radio Access Network (“E-RAN”) System.
Lastly, in January of 2020, Dali Wireless filed a patent infringement lawsuit in the U.S. District Court for the District of Delaware against JMA Wireless, alleging infringement of U.S. Patent Numbers 10,334,499 and 9,820,171 (case No. 1:19-cv-02367). Dali is seeking damages and an injunction to stop the manufacture, sale, and distribution of JMA’s TEKO® Cell Hub and XRAN® server software products.
All three lawsuits above are currently in progress.
